Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Alexandre Galambas, an individual operating from Portugal ("Tapes," "we," "us," or "our"), the operator of the Tapes mobile application (the "App" or "Service"). By creating an account or continuing past the sign-in screen, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Tapes. We check this using your device's declared age-range signal where available; if a definitive under-13 signal is returned, your account is blocked and any partially-created account is deleted. If no age signal is available or you decline to share one, you may still use the Service — we do not require you to prove your age to sign up.

2. Your account

You sign in with Sign in with Apple or Google Sign-In and choose a unique @handle. You are responsible for activity on your account. One account per person; do not share your sign-in credentials. You may sign out at any time from Settings without deleting your account or its data.

3. Your content

Tapes lets you record and post short vlogs at your own pace ("Vlogs"), made up of one or more video clips, an optional cover image ("Thumbnail"), and an optional face cut-out sticker ("Reaction") (together, "User Content"). You own your User Content. By posting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it solely to operate and provide the Service to you and, where you post publicly or to approved followers, to the audience you choose. This license ends when you delete the content or your account, except for content already shared with others or as needed for backups, legal compliance, or dispute resolution.

You are solely responsible for your User Content and confirm you have the rights to post it (including the rights of anyone else who appears in it) and that it does not violate these Terms or anyone else's rights.

4. Prohibited content and conduct

Tapes has zero tolerance for content or behavior that:

• Is spam, a scam, or otherwise deceptive or fraudulent;
• Depicts nudity or sexual content, including sexual content involving minors in any form, which we report to the relevant authorities;
• Constitutes hate speech, harassment, bullying, or targeted abuse of any person or group;
• Depicts or promotes violence, self-harm, or other dangerous acts;
• Is knowingly false or materially misleading in a way likely to cause harm;
• Infringes anyone's intellectual property, privacy, or other legal rights; or
• Is otherwise illegal, or violates our Community Guidelines.

You may report Vlogs, comments, or accounts that violate these Terms directly in the App, and you may block other accounts. We enforce these Terms through content removal, warnings, feature restriction, and account termination, at our discretion and without prior notice for serious or repeated violations.

5. Copyright policy (DMCA)

We respect intellectual property rights and respond to clear notices of alleged copyright infringement in User Content that complies with the U.S. Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

5.1 Filing a takedown notice

If you believe content on Tapes infringes your copyright, send a written notice to our designated agent below including all of the following (a notice missing any of these elements may not be actionable):

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
2. Identification of the copyrighted work claimed to have been infringed;
3. Identification of the material claimed to be infringing and information reasonably sufficient to let us locate it (e.g. a link or description of where it appears in the App);
4. Your contact information, including your address, telephone number, and an email address;
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

5.2 Designated DMCA agent

5.3 Counter-notification

If your content was removed and you believe this was a mistake or misidentification, you may submit a counter-notice to our designated agent including: your physical or electronic signature; identification of the removed material and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief the material was removed in error; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., to any judicial district in which we may be found) and that you will accept service of process from the person who filed the original notice. Upon a valid counter-notice, we may restore the content within 10–14 business days unless the original complainant files a court action seeking a restraining order.

5.4 Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright.

6. Reporting, blocking, and moderation

7. Termination

You may stop using Tapes at any time. We may suspend or terminate your access for violating these Terms, at our discretion, with or without notice. You can also delete your account and its data — see our Account & Data Deletion page.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the fullest extent permitted by law, Tapes and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your User Content or your violation of these Terms or applicable law.

11. Governing law

12. Changes to these Terms

We may update these Terms from time to time. Material changes will prompt a new acceptance the next time you use the App; your continued use after that constitutes acceptance of the updated Terms.
